According to court documents filed in Los Angeles Superior Court and obtained by PEOPLE, Burnett and her husband, Brian Miller, have been appointed temporary guardians of 14-year-old Dylan until January 8, 2021.
“The Court notes that sufficient evidence has been provided to resolve the matter within the time frame provided for that date on the basis of reading the moving documents and examining all the evidence presented,” say the documents, dated September 1st.
The petition – The appointment of a temporary guardian (later) submitted on 8/18/2020 by the petitioner (s) Carol Burnett, Brian Miller is accepted. Carol Burnett and Brian Miller are appointed temporary guardians of the person from Dylan Hamilton-West until 8/1/2021 and the provisional letters will be valid until that date, ”read the documents.
“Temporary guardians have the power to change Dylan’s school and housing pending the next court date,” the documents say.
A representative for Burnett did not comment.
The court approval comes two weeks after the Carol Burnett Show star, 87, and Miller asked to be named Dylan’s temporary guardians amid his daughter Erin Hamilton’s substance abuse problems.

The iconic actress and comedian has attempted to provide Dylan with temporary care, maintenance and support, as well as running her nephew’s affairs, according to documents obtained by PEOPLE.
“Throughout her adult life and since Dylan’s birth,
Erin has suffered from serious substance abuse issues,” the court record read. “For the past 19 years, Erin has been in and out of rehabilitation centers and has been institutionalized a total of eight times for a minimum of 30 days each time.
The file also alleged that Burnett’s daughter threatened to kill herself in July.
LAPD was called in to complete a health check for Hamilton, who was put on hold 51/50 for “suicide and drug use,” according to court documents.
Hamilton’s ex-husband Tony West, Dylan’s father, is also unable to take care of the baby as he recently visited a rehab center, documents show. As stated in the document, Burnett and her husband believe West intends to move to Nevada after he leaves and admits he is unable to provide financial support to Dylan.

“The environment in which Dylan lives has long been unstable, unpredictable and unhealthy for a child,” the document says. “This culminated in a Department of Children and Family Services (DCFS) investigation and juvenile drug addiction proceeding in 2018 and 2019.” (According to the record, Burnett was made the owner of her grandson’s education rights in September 2018.)
“Carol is Dylan’s maternal grandmother and Brian has been Carol’s husband for almost twenty years,”
the document read. “Even though Brian is not Dylan’s biological grandfather, he has known Dylan all his life and loves him as his grandson.
“The proposed co-tutors have always had a close relationship
Dylan and have supported him financially throughout his life,” the case continues. “This financial support includes the provision of medical insurance, dental insurance, educational needs, as well as her basic living and housing costs.” At this time, the proposed co-tutors are her only source of financial support and her main source of emotional support. (…) The appointment of proposed co-tutors is in Dylan’s best interest and in keeping with the love and care they already give him. This will promote Dylan’s interests in a stable and secure environment. and loving and will ensure that her needs are met in a consistent manner. ”
Hamilton is the youngest of Burnett’s three sons, all daughters, with her second husband, the late television producer Joe Hamilton.
